Agreement to terms

These terms apply to all users of KinetiqTec, including clinic administrators, practitioners and patients with portal access. If you do not agree with these terms, you should not use the platform.

Your account

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date.

Licence and access

Kinetiq Performance Group grants you a limited, non-exclusive, revocable licence to access and use KinetiqTec for its intended clinical and administrative purposes, subject to these terms and your assigned role and permissions.

Acceptable use

• Use the platform only for lawful clinical and administrative purposes.
• Respect the permissions and access controls assigned to your role.
• Not attempt to access data you are not authorised to see.
• Not misuse, reverse-engineer, or disrupt the platform or its infrastructure.
• Not enter data that you are not authorised to process.

Clinic responsibilities

Clinics are responsible for configuring access appropriately, maintaining lawful processing of patient data, obtaining valid consent where required, defining retention, and using the platform in accordance with their legal and professional obligations. Kinetiq Performance Group does not act as a healthcare provider and does not control the clinical content entered by clinics.

No medical advice

KinetiqTec is a clinical-management platform. It does not provide medical diagnoses, treatment recommendations or professional advice, and does not replace the judgement of qualified practitioners.

Fees and payment

Pricing is configured around clinic size, practitioners, locations and required functionality. Fees, billing terms and cancellation terms are set out in your agreement with Kinetiq Performance Group. Charges are processed through Base44 Payments.

Intellectual property

Kinetiq Performance Group retains all rights to the platform, its software and branding. Clinics retain ownership of the clinical and patient data they enter.

Limitation of liability

KinetiqTec is provided on an 'as is' and 'as available' basis. To the extent permitted by law, Kinetiq Performance Group is not liable for indirect or consequential losses arising from use of the platform. Clinics remain responsible for the clinical, legal and professional consequences of the data they enter and the decisions they make.

Suspension and termination

We may suspend or terminate access where these terms are breached, where required for security, or where an account or clinic is no longer authorised. Clinics may request termination and removal of their data subject to applicable legal and professional retention requirements.

Changes to these terms

We may update these terms from time to time. We will indicate the last-updated date above and, where significant, notify users within the platform.

Governing law

These terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
