Agreement to terms

These terms apply to all users of Kinetiq Tec, including clinic administrators, practitioners and patients with portal access. If you do not agree with these terms, you should not use the platform.

Age requirement

You must be at least 16 years old to create an account. Accounts for organisations are created by authorised representatives of those organisations.

Your account

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date.

Nature of the service

Kinetiq Tec is a software platform for clinical management and sports performance support. It is not itself a healthcare provider and does not deliver physiotherapy, medical treatment or regulated healthcare. Where physiotherapy, therapy or medical services are provided through the platform, they are delivered by independent clinics and practitioners who are solely responsible for the care they provide and for holding the qualifications and registrations their profession requires. Sports performance support (training programmes, monitoring, conditioning) is not a regulated healthcare service.

No medical advice and no guaranteed outcomes

The platform does not provide medical diagnoses, treatment recommendations or professional advice, and does not replace the judgement of qualified practitioners. Rehabilitation and performance features are decision-support and record-keeping tools. No outcome, recovery speed or injury-prevention result is guaranteed, and nothing on the website should be read as a promise of clinical results.

Licence and access

Kinetiq Performance Group grants you a limited, non-exclusive, revocable licence to access and use Kinetiq Tec for its intended clinical and administrative purposes, subject to these terms and your assigned role and permissions.

Acceptable use

• Use the platform only for lawful clinical and administrative purposes.
• Respect the permissions and access controls assigned to your role.
• Not attempt to access data you are not authorised to see.
• Not misuse, reverse-engineer, or disrupt the platform or its infrastructure.
• Not enter data that you are not authorised to process.

Clinic responsibilities

Clinics are responsible for configuring access appropriately, maintaining lawful processing of patient data, obtaining valid consent where required, defining retention, and using the platform in accordance with their legal and professional obligations. Kinetiq Performance Group does not control the clinical content entered by clinics.

Fees, payment and taxes

Subscription fees, the billing interval and cancellation terms are set out on our Pricing page, Billing Terms and Cancellation Policy, and are confirmed at checkout before you pay. Prices are in Euro (€) and exclude VAT; applicable VAT is added at checkout where required. Charges are processed through Base44 Payments.

Withdrawal and cancellation

Cancellation terms are set out in our Cancellation Policy. If you subscribe as a consumer, you may additionally have a statutory 14-day right of withdrawal under EU and Dutch law, as described there.

Intellectual property

Kinetiq Performance Group retains all rights to the platform, its software and branding. Clinics retain ownership of the clinical and patient data they enter. Third-party content in the exercise library remains subject to its own licence and attribution.

Limitation of liability

Kinetiq Tec is provided on an 'as is' and 'as available' basis. To the extent permitted by law, Kinetiq Performance Group is not liable for indirect or consequential losses arising from use of the platform. Clinics remain responsible for the clinical, legal and professional consequences of the data they enter and the decisions they make. Nothing in these terms excludes or limits liability where doing so is not permitted by mandatory law.

Suspension and termination

We may suspend or terminate access where these terms are breached, where required for security, or where an account or clinic is no longer authorised. Clinics may request termination and removal of their data subject to applicable legal and professional retention requirements.

Changes to these terms

We may update these terms from time to time. We will indicate the last-updated date above and, where significant, notify users within the platform.

Governing law and disputes

These terms are governed by the laws of the Netherlands. Mandatory consumer protections of your country of residence within the European Union, where applicable, remain unaffected.
